Terms of Service

These Terms of Service ("Terms") govern your access to and use of SxmplyJythyy Utilities, including the Discord bot, the website located at sxmplyjythyy.ca, associated APIs, authentication systems, applications, and related services collectively referred to as the "Services."

SxmplyJythyy Utilities is an individually owned and operated service.

By accessing or using the Services, you agree to these Terms. If you do not agree, you must not use the Services.

1. Eligibility

You may use the Services only if you are legally permitted to do so in your jurisdiction and meet the minimum age requirements applicable to Discord and any other platform through which you access the Services.

If applicable law requires permission from a parent or legal guardian for you to use an online service, you may use the Services only after obtaining that permission.

You may not use the Services if doing so would violate applicable law, regulation, court order, or contractual restriction.

2. Discord Authentication

Certain website functionality may require authentication through Discord OAuth.

SxmplyJythyy Utilities does not require you to create or provide a separate password for such accounts. Authentication is handled through Discord.

By authenticating through Discord, you authorize the Services to receive the information identified on the Discord authorization screen.

You are responsible for maintaining control of your Discord account. SxmplyJythyy Utilities is not responsible for unauthorized access resulting from compromise of your Discord account or credentials.

3. Service Accounts

An account associated with the Services may be linked to your Discord account or Discord user ID.

You agree not to:

• Abuse or disrupt the Services
• access another user's account without authorization;
• circumvent authentication or access controls;
• create accounts for fradulent or abusive purposes;
• manipulate verification systems; or
• interfere with account security.

We may suspend or terminate accounts involved in abuse, security incidents, fraudulent activity, violations of these Terms, or conduct that threatens the Services or their users.

4. Acceptable Use

You may not use the Services to:

• violate applicable law;
• harass, threaten, exploit, or abuse others;
• distribute malware or malicious code;
• perform denial-of-service attacks;
• probe, scan, or exploit infrastructure without authorization;
• bypass rate limits, authentication, permissions, or security mechanisms;
• scrape or automatically access the Services in a manner that materially burdens the infrastructure;
• use the Services for spam, phishing, fraud, or deceptive activity;
• interfere with Discord, its API, or other connected services;
• attempt unauthorized access to databases, servers, accounts, or administrative systems;
• abuse bugs or vulnerabilities rather than responsibly reporting them; or
• use the Services in a manner likely to damage their availability, integrity, or security.

5. Discord Bot Usage

When the Discord bot is added to a Discord server, authorized server administrators may configure features available to that server.

The bot may process Discord information necessary to perform requested functionality, including identifiers and publicly available account or server information.

Server administrators are responsible for ensuring that their configuration and use of the bot complies with applicable laws and Discord's rules.

6. Publicly Available Information

Some features may process information that is publicly available through Discord or other public sources.

The fact that information is publicly available does not necessarily mean that it is outside the scope of applicable privacy law. Such information will be processed in accordance with the Privacy Policy below.

7. User Content

If you submit text, configuration information, reports, requests, feedback, or other material through the Services, you retain ownership of your content.

You grant SxmplyJythyy Utilities a limited, non-exclusive license to process that content solely as necessary to:

• provide the requested functionality;
• display or transmit it as directed by you;
• maintain and secure the Services;
• investigate abuse; and
• comply with applicable legal obligations.

You represent that you have the right to submit any content you provide.

8. Intellectual Property

Except for user-provided content and third-party materials, the Services, including original software, branding, design, documentation, and other original material, are owned by or licensed to SxmplyJythyy Utilities.

These Terms do not transfer ownership of the Services to you.

You may not copy, sell, sublicense, redistribute, reverse engineer, or commercially exploit protected portions of the Services except where expressly authorized or where such restriction is prohibited by law.

9. Third-Party Services

The Services may interact with third parties including Discord, infrastructure providers, security providers, APIs, and other platforms.

Those services operate under their own terms and privacy practices.

SxmplyJythyy Utilities does not control third-party platforms and is not responsible for outages, policy changes, account actions, data processing, or other conduct attributable to those providers.

10. Availability

The Services are provided on an availability-dependent basis.

We do not guarantee that the Services will:

• operate continuously;
• remain error-free;
• support every Discord server or account;
• retain every existing feature;
• remain compatible with third-party APIs; or
• be available indefinitely.

Maintenance, security incidents, hardware failures, network failures, software changes, or third-party outages may interrupt service.

11. Changes to the Services

Features may be added, changed, restricted, replaced, or discontinued.

Where a change materially affects how personal information is processed, the Privacy Policy will be updated as appropriate.

12. Suspension and Termination

Access may be limited or terminated where reasonably necessary to:

• enforce these Terms;
• protect users;
• protect infrastructure;
• prevent abuse or fraud;
• comply with law;
• address security concerns; or
• discontinue a feature or the Services.

You may stop using the Services at any time.

Where an account deletion mechanism is available, you may also request deletion as described in the Privacy Policy.

13. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Services are provided “as is” and “as available.”

No warranty is made that the Services will be uninterrupted, error-free, completely secure, or suitable for a particular purpose.

Nothing in these Terms excludes warranties, guarantees, or consumer rights that cannot lawfully be excluded.

14. Limitation of Liability

To the maximum extent permitted by law, SxmplyJythyy Utilities will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages resulting from use of or inability to use the Services.

This includes, where legally permitted, loss resulting from:

• third-party service outages;
• Discord account actions;
• loss of data;
• unauthorized account access not caused by the Services;
• service interruptions; or
• user misuse.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

15. Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims resulting from your unlawful use of the Services, your violation of these Terms, or your infringement of another person's rights.

This provision does not apply where prohibited by consumer-protection law.

16. Governing Law

These Terms are governed by the laws legally applicable to the individual operator of SxmplyJythyy Utilities, subject to any mandatory consumer-protection laws applicable in your jurisdiction.

Nothing in these Terms deprives a consumer of rights that cannot lawfully be waived.

17. Changes to These Terms

These Terms may be amended when necessary because of changes to the Services, law, security practices, or third-party requirements.

The “Last Updated” date will identify the latest revision.

Material changes may also be announced through the website, Discord bot, or another reasonable notice mechanism.

Continued use after an updated version becomes effective constitutes acceptance where permitted by law.
